“The Shayla Moment”, “we”, “us” and “our” refer to The Shayla Moment Ltd.

By using this website or placing an order, you agree to these terms. Nothing in these terms affects your statutory consumer rights.

1. Using our website

You must provide accurate and complete information when placing an order.

You must not:

  • Use the website unlawfully

  • Submit false information

  • Place fraudulent orders

  • Interfere with the website’s security or operation

  • Copy or commercially use our content without permission

We may restrict access where we reasonably believe the website is being misused.

2. Product information

We take reasonable care to describe and display our products accurately.

Please review the product page before ordering, including:

  • Size and length

  • Colour

  • Fabric

  • Fit

  • Care instructions

  • Items included

Colours may appear slightly different depending on lighting, photography and screen settings.

Measurements are approximate and minor variations may occur.

Accessories shown in photographs are not included unless this is clearly stated in the product description.

3. Orders

Placing an order is an offer to purchase the selected products.

Your order is accepted when we send confirmation that it has been dispatched.

We may decline or cancel an order where:

  • Payment is not authorised

  • The item is unavailable

  • Pricing or product information contains an obvious error

  • Delivery information is incomplete

  • We reasonably suspect fraud or misuse

If we cancel an order after taking payment, we will refund the amount paid to the original payment method.

Adding an item to your basket does not reserve it.

4. Prices and payment

Prices are shown in pounds sterling unless stated otherwise.

Delivery charges and the total amount payable will be shown before you complete checkout.

Payment must be made through an available checkout method.

You confirm that you are authorised to use the payment method provided.

We may change prices at any time, but this will not affect an order that has already been accepted.

If a product is displayed with an obvious pricing error, we may cancel the order and issue a refund.

5. Stock

All products are subject to availability.

If an item becomes unavailable after you order, we will contact you and refund the unavailable item.

6. UK delivery

Our current UK delivery terms are:

  • Orders below £100: £5.99 standard delivery

  • Orders of £100 or more: free standard delivery

  • Dispatch: normally within 3 to 5 working days

  • Standard delivery: approximately 5 to 7 working days after dispatch

Delivery periods are estimates unless we expressly agree otherwise.

We are not responsible for delays caused by events outside our reasonable control, including courier disruption, severe weather, public holidays and incorrect delivery information.

You are responsible for checking your delivery address before submitting the order.

Contact us immediately if an address is incorrect. We cannot guarantee changes after processing has started.

Risk in the products passes to you when the order is delivered to you or to a person nominated by you.

7. International delivery

International delivery is available only where a live international shipping option appears at checkout.

Customers may be responsible for customs charges, duties or local taxes where applicable. These are not included unless expressly stated at checkout.

International delivery estimates may be affected by customs processing and local courier services.

8. Failed delivery

If a parcel is returned to us because:

  • The address supplied was incorrect or incomplete

  • Delivery was refused

  • The parcel was not collected

  • The courier could not complete delivery after reasonable attempts

we may require payment of reasonable redelivery costs.

If a refund is requested instead, we may deduct reasonable delivery or return costs where permitted by law.

This does not apply where the failed delivery was caused by us or the courier.

9. Cancellations and returns

Our Returns Policy forms part of these terms.

For eligible standard online purchases, you may request cancellation within 14 days of receiving your order.

After notifying us, you must send the eligible item back promptly and within a further 14 days.

Customers are responsible for arranging and paying for change-of-mind return postage where stated before purchase.

Returned items must meet the conditions in our Returns Policy.

We may reduce a refund where an item has been handled beyond what is reasonably necessary to check its nature, fit and condition.

10. Exchanges

We do not offer direct exchanges.

Where an item is eligible for return, you may return it for a refund and place a new order for the preferred size, colour or style.

11. Returned-item condition

For a change-of-mind return, the item must be:

  • Unworn, unused and unwashed

  • Unaltered and undamaged

  • In its original condition

  • Returned with its original packaging

  • Returned with all original tags and security tags attached

  • Free from make-up, perfume, deodorant, stains, pet hair, odours and signs of wear

Removing or tampering with a security tag may make a change-of-mind return ineligible.

This does not affect your rights where an item is faulty, damaged, incorrect or not as described.

12. Personalised products

Products genuinely made to your individual measurements, personalised at your request or made to your specific requirements may not be returned for a change of mind.

Selecting a standard size, colour or option offered on the website does not automatically make an item personalised.

This restriction does not apply where the item is faulty, damaged, incorrect or not as described.

13. Refunds

Once an eligible return has been received and inspected, we will notify you of the outcome.

Approved refunds will be issued to the original payment method within the applicable legal timeframe.

For an eligible cancellation of a complete order, the basic standard outbound delivery charge will be refunded where required by law.

Any additional amount paid for express or enhanced delivery will not be refunded unless required by law.

Your bank or payment provider may take additional time to display the funds.

14. Faulty, damaged or incorrect items

Contact us as soon as possible if an item is:

  • Faulty

  • Damaged

  • Incorrect

  • Not as described

Please provide:

  • Your name

  • Order number

  • Details of the issue

  • Clear photographs where reasonably requested

We may ask you to return the item for inspection.

Nothing in these terms limits your rights under the Consumer Rights Act 2015 or other applicable consumer law.

15. Promotions and discount codes

Discount codes:

  • Must be entered before checkout is completed

  • Cannot be exchanged for cash

  • Cannot normally be applied retrospectively

  • May have expiry dates, exclusions or minimum-spend requirements

  • Cannot be combined unless expressly permitted

We may withdraw or cancel a discount used fraudulently or contrary to its stated conditions.

16. Intellectual property

Our branding, logo, photographs, graphics, product names, written content and website design belong to us or are used with permission.

You may use the website for personal shopping purposes only.

You must not reproduce, distribute, publish, sell or commercially exploit our content without written permission.

17. Reviews and submitted content

If you submit a review, photograph, comment or other content, you confirm that:

  • It reflects your genuine experience

  • You own it or have permission to share it

  • It does not infringe another person’s rights

  • It is not misleading, unlawful, abusive or defamatory

You grant us a non-exclusive, royalty-free right to display and use that content in connection with operating and promoting The Shayla Moment.

We may remove content that breaches these terms.

18. Third-party services

Our website uses Shopify and may use payment providers, couriers and other third-party services.

Those services may have their own terms and privacy notices.

We are not responsible for third-party websites or services that we do not control.

19. Privacy and cookies

We process personal information in accordance with our Privacy Policy.

The website uses necessary cookies and may use analytics or marketing cookies where consent is required and obtained.

20. Liability

We do not exclude or limit liability where doing so would be unlawful.

This includes liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Breach of statutory consumer rights

  • Any liability that cannot legally be excluded

We are responsible for reasonably foreseeable losses caused by our breach of these terms or failure to use reasonable care and skill.

We are not responsible for:

  • Losses that were not reasonably foreseeable

  • Business or commercial losses arising from a consumer purchase

  • Delays or failures caused by events outside our reasonable control

Our products are supplied for personal and domestic use unless otherwise agreed.

We are not responsible for delays or failures caused by events outside our reasonable control.

These may include:

  • Courier disruption

  • Severe weather

  • Industrial action

  • Transport interruptions

  • Supplier disruption

  • Government action

  • System or network failures

We will take reasonable steps to reduce the impact where possible.

The terms applying to your purchase are those in effect when your order was placed.

These terms are governed by the laws of England and Wales.

Customers living in Scotland or Northern Ireland retain any mandatory legal rights and access to courts available to them under applicable law.
